Cancel a Registration
The registration of any enterprise that fails to file two consecutive annual updating declarations may be cancelled ex officio by the Registraire des entreprises pursuant to section 59 of the Act respecting the legal publicity of enterprises.
However, before cancelling ex officio the registration, the Registraire des entreprises sends a notice of default and gives the enterprise 60 days to meet its legal obligations.
The Registraire des entreprises proceeds with the ex officio cancellation of the enterprises that have failed to file the required documents, then sends them a notice of cancellation.
The notice of cancellation will be deposited in the enterprise register and recorded in the Documents conservés section of the État de renseignements (information statement).
- Note
- The Act respecting the legal publicity of enterprises makes provision for a revocation of cancellation for enterprises cancelled ex officio for failure to file two consecutive annual updating declarations or a declaration or a notice required pursuant to section 73 of the Act.
