Notice of Striking Off
Any enterprise that fails to file two consecutive annual updating declarations may be struck off ex officio by the enterprise registrar pursuant to s. 59 of the Act respecting the legal publicity of enterprises.
The enterprise registrar engages twice a year in two extensive ex officio striking off operations for failure to file annual declarations:
- in the spring, in the case of legal persons, associations and other groups;
- in the fall, in the case of sole proprietorships and business corporations.
During these periods, the enterprise registrar publishes a notice of striking off on its website. Enterprises whose registration is likely to be struck off ex officio are listed in alphabetical and numerical order (by NEQ) in the News section several weeks before the extensive striking off operation.
After the publication, the enterprise registrar proceeds with the ex officio striking off of the enterprises that have failed to file the required documents, then sends them a decision to strike off.
- Note
- The Act respecting the legal publicity of enterprises makes provision for a revocation of striking off for enterprises struck off ex officio for failure to file two consecutive annual updating declarations or a declaration or a notice required pursuant to s. 73 of the aforesaid Act.
