Sanctions and Penalties

Civil sanctions

A business that is required to register and fails to do so, or that has been struck off ex officio, may have its right to appear in court suspended.

A legal person constituted in Québec that has been struck off is deemed to be dissolved.

Penal sanctions

A business that fails to produce the declarations required by law is liable to a fine ranging from $200 to $2,000 for an individual (from $400 to $4,000 for a legal person). This fine may be doubled in the event of a repeat offence.

Moreover, any director, officer or authorized representative of a registrant who ordered, authorized or advised commission of an offence or consented to or otherwise took part in the offence, is guilty of an offence and liable to a fine ranging from $200 to $2,000, and which may double in the event of a repeat offence.
